1. Purpose
These general terms of use (the “Terms”) govern access to and use of the AWIICOM website and the business messaging platform available at app.awiicom.com (the “Platform”), published by AWIICOM, Blvd du Général de Gaulle, Djibouti.
By creating an account or using the Platform, the customer (the “Customer”) accepts these Terms without reservation.
2. Services
AWIICOM provides in particular:
- marketing and transactional SMS (bulk sending, custom sender name, templates, contact management, reporting);
- WhatsApp Business messaging;
- hosting of local SIM cards managed from the client portal;
- an integration API to automate sending.
Details of features and prices are available on the Platform or in the commercial offer provided to the Customer.
3. Account creation and security
- The Customer provides accurate and up-to-date information when signing up and keeps it up to date.
- Login credentials and API keys are personal and confidential. The Customer is responsible for any use of their account.
- The Customer notifies AWIICOM without delay of any unauthorised use of their account.
4. Customer obligations and acceptable use
The Customer undertakes to use the services in compliance with applicable laws and, in particular:
- to send commercial messages only to recipients who have given their prior consent, and to honour any unsubscribe request;
- to have a legal basis for the contact data imported into the Platform;
- to use as sender name only names over which they hold rights;
- not to send unlawful, fraudulent or misleading content (phishing, impersonation), hateful or defamatory content, or content infringing third-party rights;
- to comply with operator rules and Meta policies applicable to WhatsApp Business;
- not to attempt to disrupt, bypass or compromise the security of the Platform.
The Customer is solely responsible for the content of the messages they send and indemnifies AWIICOM against any claim relating to that content or to their recipient list.
5. Prices, credits and payment
Unless otherwise agreed, services operate on prepaid credits: the Customer buys credits on the Platform, which are then deducted with each message sent according to the current price list or the offer accepted by the Customer.
Amounts are shown in Djiboutian francs (DJF).
Purchased credits remain valid for 12 months from their date of purchase. After that, unused credits expire. Used or expired credits are non-refundable.
Accepted payment methods are:
- Waafi;
- D-Money;
- CAC Pay;
- bank transfer;
- cash.
Credits are added to the Customer’s account once payment has been confirmed.
6. Service availability
AWIICOM uses reasonable efforts to ensure continuous access to the Platform, with a target uptime of 99.95%. This target does not constitute a guarantee, unless a specific service level commitment is set out in the Customer’s contract.
Interruptions may occur for maintenance or updates, or in the event of an incident affecting an operator or a third-party provider. Actual delivery of a message also depends on operator networks and the state of the recipient’s device.
7. Suspension and termination
AWIICOM may suspend or terminate a Customer’s access, without notice or compensation, in the event of a breach of these Terms, in particular for spam, unlawful content or non-payment.
The Customer may close their account at any time. The offer has no minimum term, unless otherwise agreed.
8. Liability
AWIICOM is bound by an obligation of means. It cannot be held liable in the event of force majeure, failure of operator networks, misuse of the services by the Customer or content sent by the Customer.
In any event, AWIICOM’s liability is limited to direct damage and capped at the amount paid by the Customer during the last 12 months.
9. Personal data
The processing of personal data is described in the privacy policy. For the data of their recipients, the Customer acts as data controller and AWIICOM as data processor.
10. Intellectual property
The Platform, its code, its interfaces and the AWIICOM brand remain the exclusive property of AWIICOM. The Customer is granted a personal, non-exclusive and non-transferable right of use for the duration of their subscription. The Customer retains ownership of their content and data.
11. Changes to the Terms
AWIICOM may amend these Terms. Customers are informed of material changes by email or via the Platform. Continued use of the services constitutes acceptance of the new terms.
12. Governing law and disputes
These Terms are governed by the laws of the Republic of Djibouti. In the event of a dispute, the parties will seek an amicable solution before taking legal action. Failing that, the dispute will be brought before the competent courts of Djibouti.
